Article 1 Purpose
The purpose of these terms is to regulate the rights, obligations, and responsibilities of the "Company" and the users in the use of the internet-related services (hereinafter referred to as "Services") provided by WOOYOUNGMI.COM (hereinafter referred to as "WOOYOUNGMI.COM") operated by Solid Co., Ltd. (e-commerce business, hereinafter referred to as "Company").
※ These terms shall apply to the electronic commerce using PC communication or wireless communication unless it is contrary to its nature.
Article 2 Definitions
The terms used in these terms are defined as follows.
① "WOOYOUNGMI.COM" refers to the fictitious business place set up to trade goods and services (hereinafter referred to as "goods, etc.") using information and communication facilities such as computers and mobile services in order for the "company" to provide "goods, etc." to the user. It is also used to refer to the business that operates “WOOYOUNGMI.COM”.
② “User” refers to members and non-members who access “WOOYOUNGMI.COM” and receive the “Services” provided by “WOOYOUNGMI.COM” according to the terms.
③ “Member” means a person who has registered as a member of “WOOYOUNGMI.COM” and who can use the “Services” provided by “WOOYOUNGMI.COM” continuously.
④ “Non-member” refers to a person who uses the “Services” provided by “WOOYOUNGMI.COM” without registering as a member.
⑤ “Biological information” refers to information of physical or behavioral characteristics that can identify an individual such as a fingerprint or face.
⑥ “Authentication Information” is a member authentication method used in the procedure of the "Services". "Payment password," "biological information," "authorized certificate," etc., are applicable as identification methods recognized by “WOOYOUNGMI.COM”.
Article 3 Specification and Amendment
① The “Company” shall post the contents of these terms, company name, business location, name of the representative, business registration number, contact information (telephone, fax, e-mail address, etc.) on the initial "Services" screen of “WOOYOUNGMI.COM” so that users can easily understand it. However, the contents of the terms can be made available to the user through a connecting screen.
② “WOOYOUNGMI.COM” shall provide a separate connecting screen or pop-up screen so that the user can understand important contents such as application withdrawal, delivery responsibility, and refund conditions from the contents laid out in the terms to receive confirmation from the user before the user agrees to the terms.
③ “WOOYOUNGMI.COM” can amend the terms to the extent that it does not violate any related law such as the “Framework Act on Consumers,” “Law on Consumer Protection in Electronic Commerce, etc.,” “Act on the Regulation of Terms and Conditions, etc.,” “Framework Act on Electronic Commerce,” “Digital Signature Act,” “Act on Promotion of Information and Communication Network Utilization, etc.,” and “Act on Door to Door Sales, etc.”
④ When “WOOYOUNGMI.COM” revises the terms, it shall specify the date of application and the reason for the revision and shall post the notice along with the current terms on the initial screen of “WOOYOUNGMI.COM” 7 days before the date of application to the date of application. However, if the contents of the terms are changed against the user, the notice shall be given with at least 30 days prior grace period. In this case, “WOOYOUNGMI.COM” shall clearly compare the contents before and after the revision and display them for easy understanding.
⑤ When “WOOYOUNGMI.COM” revises the terms, the revised terms will apply only to the contracts concluded after the date of application, and the pre-revision terms will be applied to the contracts already concluded before that date. However, if a user who has already entered into a contract sends their wishes to apply the provisions of the revised terms to “WOOYOUNGMI.COM” within the notice period of the revised terms under paragraph 3 and receives the consent of “WOOYOUNGMI.COM”, the revised terms will apply.
⑥ For matters not defined in these terms and interpretation of these terms, it will comply with commercial practices or related laws such as "Law on Consumer Protection in Electronic Commerce, etc.," "the Act on the Regulation of Terms and Conditions, etc.," and "Consumer Protection Guidelines in Electronic Commerce, etc." determined by the Fair Trade Commission.
Article 4 Provision and Change of Service
① “WOOYOUNGMI.COM” performs the following tasks.
1. Provision of information on goods and services and the conclusion of purchase contracts
2. Delivery of goods or services for concluded purchase contracts
3. Other tasks prescribed by "WOOYOUNGMI.COM"
② “WOOYOUNGMI.COM” may change the contents of “goods, etc.” to be provided based on contracts signed in the future in case of the "goods, etc." going out of stock or due to changes in technical specifications. In this case, the details of the changed “goods, etc.” and the date of delivery shall be specified and immediately notified where the current “goods, etc.” contents are posted.
③ If the contents of the "Services" contracted by the user to be provided by "WOOYOUNGMI.COM" is changed due to the goods going out of stock or changes in technical specifications, the reason shall be notified immediately to the user to the address (including email address) that can receive the notice.
④ In the case of the preceding paragraph, “WOOYOUNGMI.COM” shall compensate for the damage suffered by the user. However, this is not the case when it can be proven that “WOOYOUNGMI.COM” is free of intention or negligence.
Article 5 Interruption of Service
① “WOOYOUNGMI.COM” may temporarily suspend the provision of “Services” in the event of maintenance, replacement, breakdowns or interruption in information and communication facilities such as computers.
② “WOOYOUNGMI.COM” shall compensate for damages suffered by the user or a third party due to the suspension in the provision of the “Services” for the reason of Paragraph 1. However, this is not the case when it can be proven that “WOOYOUNGMI.COM” is free of intention or negligence.
③ If it becomes impossible to provide “services” due to the change of business items, abandonment of business, integration between companies, etc., “WOOYOUNGMI.COM” shall notify the users using the method decided in Article 8 and compensate the consumer according to the conditions originally suggested by “WOOYOUNGMI.COM”. However, in the event that “WOOYOUNGMI.COM” does not consider the compensation standards, the Solid Mileage, etc. of the user will be paid by kind that corresponds to the currency value used at “WOOYOUNGMI.COM”.
Article 6 Membership
① The user shall apply for membership by filling in the member information according to the registration form set by "WOOYOUNGMI.COM" and expressing their intention to agree to these terms.
② “WOOYOUNGMI.COM” shall register those who apply to become a member according to Paragraph 1 as a member unless the following applies.
1. If the applicant has previously lost membership qualifications in accordance with Article 7, Paragraph 3 of these terms. However, an exception shall be made for a person after 3 years since they lost their membership qualifications under Article 7, Paragraph 3 if they receive membership re-registration approval from “WOOYOUNGMI.COM”.
2. If there is any false, missing or misleading registration content.
3. If it is judged that registering as other member is significantly impeded by the technology of "WOOYOUNGMI.COM".
③ The date of establishment of the membership contract shall be the point when the acceptance from “WOOYOUNGMI.COM” reaches the member.
④ In the event that there is a change in the registration information under Article 16, Paragraph 1, the member shall immediately notify "WOOYOUNGMI.COM" of the change by e-mail or other means.
Article 7 Membership Withdrawal and Disqualification
① Members can request to withdraw at any time from “WOOYOUNGMI.COM” and “WOOYOUNGMI.COM” will immediately process the withdrawal.
② If a member falls under any of the following, “WOOYOUNGMI.COM” may restrict or suspend membership.
1. If false information is registered at the time of application.
2. If the member does not pay the debts borne by the member in connection with the payment for goods, etc. purchased using “WOOYOUNGMI.COM” or other “WOOYOUNGMI.COM” uses.
3. If it threatens the order of e-commerce by interfering with other people's use of “WOOYOUNGMI.COM” or stealing the information.
4. If acting against the public order and morals or in ways that are prohibited by the law or these terms using “WOOYOUNGMI.COM".
③ If "WOOYOUNGMI.COM" restricts or suspends membership and the same act is repeated more than once or if the reason is not corrected within 30 days, "WOOYOUNGMI.COM" may take away the membership qualification.
④ In the event that “WOOYOUNGMI.COM” takes away membership, membership registration will be terminated. In this case, the member shall be notified of this, and the member shall be given a chance to explain for at least 30 days before the termination of membership registration.
Article 8. Notice about Members
① In the event that “WOOYOUNGMI.COM” notifies a member, it can be done through the e-mail address designated by the member in advance with “WOOYOUNGMI.COM”.
② “WOOYOUNGMI.COM” can replace individual notice for notifications to unspecified members by posting on the “WOOYOUNGMI.COM” bulletin board for more than one week. However, individual notification shall be given of matters that have a significant impact on the member's transactions.
Article 9. Purchase Application
① The user shall apply for purchase by the following or similar method on “WOOYOUNGMI.COM”, and “WOOYOUNGMI.COM” shall provide each of the following contents clearly in the user's purchase application. However, the application of numbers 2 to 4 can be excluded for members.
1. Search and select “goods, etc.”
2. Enter the recipient's name, address, telephone number (or mobile number), e-mail address, etc.
3. Confirm the contents of the terms and conditions, the “Services” for which the right to withdraw subscriptions is limited, and the contents related to the cost burden such as shipping and installation costs.
4. Agree to these terms and mark confirmation or rejection to the item in number 3 (Ex: mouse click).
5. Confirm the purchase application of the "goods, etc." and the related or agree to the confirmation of “WOOYOUNGMI.COM”.
6. Select the payment method.
② If “WOOYOUNGMI.COM” needs to provide or entrust the buyer's personal information to a third party, it must obtain the buyer's consent when they are applying for the actual purchase and it shall not receive a comprehensive consent in advance at the time of membership registration. At this time, “WOOYOUNGMI.COM” shall specify to the buyer the usage purpose and the retention and usage period of the provided personal information items, recipient, and the personal information of the recipient. However, it shall comply if there are other provisions in the related laws and regulations such as the case of entrustment of personal information processing pursuant to Article 25 of "Act on Promotion of Information and Communication Network Utilization and Information Protection, etc."
Article 10 Establishment of Contract
① “WOOYOUNGMI.COM” may not accept the purchase application or continuously refuse the future transaction for the members or purchase applications that are like the following items. However, in the case of entering a contract with a minor, it must notify that the minor or their legal representative may cancel the contract if the consent of the legal representative cannot be obtained.
1. For 'members' or purchase application case where the same 'member' repeatedly returns (refunds) the product after purchasing, even though the product is not defective, and is judged to be of concern in harming other 'members' by limiting the product purchase opportunity of other members.
2. For 'members' or purchase application case where they return the product after deliberately damaging it to avoid the cost of return when returning purchased product or when the circumstance clearly indicates that some items are intentionally missing in the return after the purchase of multiple products.
3. For 'members' or purchase application case where the purchase application is for the purpose of commercial activities such as resale or purchase agent or it is judged by the transaction circumstance that the purchases are made for commercial activities.
4. For 'members' or purchase application case where the purchasing activity purpose is to infringe on intellectual property rights by imitating or duplicating the relevant product design or trademark, or it is judged by the transaction circumstance that the purpose is for these types of infringement.
5. For 'members' or purchase application case of abnormal transaction activities with the purpose of receiving free gifts by returning only the purchased product and keeping the free gifts.
6. If there is any false, missing or misleading information in the application.
7. If the acceptance of other purchase application is judged to be significantly impeded by the "WOOYOUNGMI.COM" technology.
② The contract is concluded when the acceptance of “WOOYOUNGMI.COM” reaches the user in the form of receipt confirmation notice in Article 12, Paragraph 1.
③ The declaration of acceptance of “WOOYOUNGMI.COM” shall include information on the confirmation of the user's purchase application and whether the sale is possible, correction of the purchase application, cancellation, etc.
Article 11 Payment Method
Payment method for “goods, etc.” purchased from “WOOYOUNGMI.COM” may be made by any of the following methods. However, “WOOYOUNGMI.COM” shall not collect any nominal fee in addition to the payment of “goods, etc.” regarding the payment method of the user.
1. Various account transfers such as internet banking, etc.
2. Various card payments such as prepaid card, debit card, credit card, etc.
3. Payment by other electronic payment methods
Article 12 Receipt Confirmation Notice, Change and Cancellation of Purchase Application
① “WOOYOUNGMI.COM” will notify the user of the receipt confirmation notice if there is a purchase application of the user.
② The user who has received the receipt confirmation notice may request a change and cancellation of the purchase application immediately after receiving the receipt confirmation notice if there is a discrepancy in the indication of the intention. “WOOYOUNGMI.COM” shall process according to this request without delay if requested by the user before shipping. However, if the payment has already been made, it will follow the application withdrawal-related regulation of Article 15.
Article 13 Supply of Goods, etc.
① “WOOYOUNGMI.COM” shall take other necessary measures such as custom orders, packaging, etc. to enable the delivery of goods, etc. within 7 days of the user's application unless otherwise agreed upon with the user on the timing of goods, etc. supply. However, if "WOOYOUNGMI.COM" has already received all or part of the payment of the goods, etc. the action shall be taken within three business days from the date of receipt of all or part of the payment. At this time, “WOOYOUNGMI.COM” shall take appropriate measures to allow the user to check the supply procedure and progress of the “goods, etc.”.
② “WOOYOUNGMI.COM” specifies the delivery method, the bearer of the shipping cost by each method, and the delivery period by each method of the goods purchased by the user. If “WOOYOUNGMI.COM” exceeds the contract delivery period, it will be required to compensate for the loss of the user. However, this is not the case when it can be proven that “WOOYOUNGMI.COM” is free of intention or negligence.
③ If there is a separate agreement between "WOOYOUNGMI.COM" and the consumer about when the product will be delivered or when the services will be provided, that agreement shall take precedence over these terms.
Article 14 Refunds
“WOOYOUNGMI.COM” shall notify the user without delay of the reason when the goods purchased by the user cannot be delivered due to reasons such as going out of stock or if the service cannot be provided. If the payment for the goods, etc. have been received prior, return or the return procedure should be taken within 3 days of receiving the payment.
Article 15 Application Withdrawal, etc.
① A customer who has entered into a contract with "WOOYOUNGMI.COM" regarding the purchase of goods or services may withdraw the application within 7 days of receiving the notification of receipt confirmation.
② The user may not return or exchange the goods, etc. after receiving the delivery if it corresponds to 1 of the following items.
1. If the "goods, etc." are lost or damaged due to the responsibility of the user (However, if the packaging, etc. are damaged in order to check the contents of the "goods, etc." the application can be withdrawn.)
2. If the value of the “goods, etc.” has decreased significantly due to the use of the user or from partial consumption.
3. If the value of the “goods, etc.” has decreased significantly to the extent that resale is difficult due to the passage of time.
4. If reproduction into "goods, etc." with the same performance is possible and the original packaging of the "goods, etc." is damaged.
③ In the case of Paragraph 2, Subparagraphs 2 to 4, if "WOOYOUNGMI.COM" did not take measures such as specifying in advance where the consumer can easily know that the withdrawal of the application is limited or providing trial products, the withdrawal of the application of the user is not limited.
④ The user can withdraw the application within 3 months from the date of receiving the "goods, etc." or within 30 days since the date of knowing or possibly knowing the fact if the content of the "goods, etc." differs from the label and advertisement, or is implemented differently than the contract, despite the regulations of Paragraph 1 and 2.
Article 16 The Effects of Application Withdrawal, etc.
① "WOOYOUNGMI.COM" will refund the payment of the "goods, etc." already paid within 3 business days if the goods, etc. are returned from the user after the withdrawal of the application in accordance with Article 16 of these terms. In this case, when “WOOYOUNGMI.COM” delays the refund of the “goods, etc.” to the user, the delayed interest calculated by multiplying the delayed interest rate determined by the Fair-Trade Commission for the delayed period shall be paid.
② In refunding the payment above, “WOOYOUNGMI.COM” shall stop or cancel the payment of the "goods, etc." through the provider of the payment method without delay when the user has paid for the "goods, etc." through a payment method of credit card or electronic money.
③ In the case of withdrawal of the application, the user shall bear the cost of returning the “goods, etc.” received. “WOOYOUNGMI.COM” does not claim any penalty or damage compensation for the user's withdrawal of the application. However, if the application withdrawal happens because the contents of the "goods, etc." are different from the label and advertisement or the contract is implemented differently, "WOOYOUNGMI.COM" shall bear the cost of returning the goods.
④ If the user bears the shipping cost when receiving the “goods, etc.”, “WOOYOUNGMI.COM” shall clearly indicate who is responsible for the cost when the application is withdrawn.
Article 17 Protection of Personal Information
① “WOOYOUNGMI.COM” collects the minimum personal information necessary to provide the “Services” when collecting user's personal information.
② “WOOYOUNGMI.COM” does not collect the information necessary for the fulfillment of the purchase contract in advance. However, this is not the case when minimum specific personal identification is required for identification prior to the purchase contract for the performance of obligations under related laws.
③ When WOOYOUNGMI.COM collects and uses the user's personal information, it informs the user of the purpose and obtains consent. However, there is an exception when it is otherwise provided in the relevant law and regulations.
④ “WOOYOUNGMI.COM” cannot use the collected personal information for any intent other than the purpose. If a new purpose of use arises or if providing to a third party, it shall notify the user of the purpose at the stage of use and provision and receive consent. However, there is an exception when it is otherwise provided in the relevant law and regulations.
⑤ “WOOYOUNGMI.COM” needs to specify or notify in advance when they need to receive the consent of the user on the matters regulated by Article 22, Paragraph 2 of the Act on the Promotion of Information and Communication Network Act, etc. such as the identity of the personal information manager (affiliation, name, phone number and other contact), the purpose of collection and use of the information, related matters on providing information to third parties (recipient, purpose of provision, contents of the information to be provided). The user can withdraw this consent at any time.
⑥ The user may request to view, and correct errors of their own personal information held by “WOOYOUNGMI.COM” at any time, and “WOOYOUNGMI.COM” shall be obliged to take necessary measures without delay. If the user requests correction of an error, “WOOYOUNGMI.COM” will not use the personal information until the error is corrected.
⑦ “WOOYOUNGMI.COM” restricts the number of managers to protect personal information and minimizes the number. It assumes all responsibility for the loss, theft, leakage, or alteration of the user's personal information including credit cards and bank accounts.
⑧ “WOOYOUNGMI.COM” or a third party who has received personal information from it will destroy the personal information without delay when the purpose of collecting or receiving personal information is achieved.
⑨ The "Company" does not set the agreement on collection, usage, and provision of personal information as what was selected in advance. In addition, it specifies in detail the “Services” that are limited when users refuse to consent to the collection, use, and provision of personal information. It does not restrict or reject the provision of "Services" such as membership registration because the user refuses to consent to the collection, usage, and provision of personal information that is not a required collection item.
Article 18 Obligations of “WOOYOUNGMI.COM”
① “WOOYOUNGMI.COM” shall not do anything that is prohibited by law or these terms or contrary to public order and morals. Every effort must be made to provide the “goods, etc.” consistently and reliably as defined in these terms.
② “WOOYOUNGMI.COM” shall be equipped with a security system to protect the user's personal information (including credit information) so that the user can use the internet service safely.
③ “WOOYOUNGMI.COM” shall be responsible for the compensation when there are any damages to the user due to unfair labeling or advertisement in accordance with Article 3 of the Act on the Fairness of Labeling and Advertising with respect to the “goods, etc.”.
④ “WOOYOUNGMI.COM” does not send advertisement e-mail that the users do not want for profit purposes.
Article 19 Obligations on Member ID and Password
① Members are responsible for managing their ID and password except in the case of Article 17.
② Members should not let their ID and password be used by third parties.
③ If a member recognizes that their ID and password have been stolen or are used by a third party, they shall immediately notify “WOOYOUNGMI.COM” and follow any given instructions of “WOOYOUNGMI.COM”.
Article 20 Obligations of User
The user should not carry out the following actions.
1. Registration of false information when applying or changing.
2. Use of another person's information.
3. Change the information posted on “WOOYOUNGMI.COM“
4. Send or post information (computer program, etc.) other than the information prescribed by "WOOYOUNGMI.COM"
5. Infringe on the intellectual property rights such as copyright of “WOOYOUNGMI.COM” and other third parties.
6. Acts that damage or obstruct the honor of “WOOYOUNGMI.COM“ and other third parties.
7. Disclose or post information on the mall that is against public order and morals such as pornography or violent messages, images, voices, etc.
Article 21 Copyright Attribution and Restrictions of Use
① Copyright and other intellectual property rights of the work created by “WOOYOUNGMI.COM” belong to “WOOYOUNGMI.COM”.
② The user cannot use information with copyright attribution to “WOOYOUNGMI.COM” from the information obtained from using “WOOYOUNGMI.COM” or make it available to third parties without prior consent for profit purposes by copying, transmitting, publishing, distributing, broadcasting and other methods.
③ “WOOYOUNGMI.COM” shall notify the relevant user when using copyright belonging to the user according to these terms.
Article 22 Dispute Settlement
① “WOOYOUNGMI.COM” will install and operate a damage compensation mechanism to reflect the just opinions and complaints raised by users and to compensate for the damages.
② “WOOYOUNGMI.COM” will process the complaints and opinions submitted from users as a priority. However, if prompt processing is difficult, the user will be notified immediately of the reason and processing schedule.
③ If there is a request for damage remedy related to an e-commerce dispute between “WOOYOUNGMI.COM” and the user, it may be subject to the mediation of a dispute mediation agency requested by the Fair-Trade Commission or the city or provincial governor.
Article 23 Jurisdiction and Governing Law
① Lawsuits concerning electronic transaction disputes between “WOOYOUNGMI.COM” and users shall be based on the address of the user at the time of filing, and in the absence of an address, it shall be the exclusive jurisdiction of the district court with jurisdiction of the place. However, if the user's address or residence is not clear at the time of filing, or if they are a foreign resident, they shall file it with the competent court under the civil procedure law.
② Korean law shall apply to e-commerce litigations filed between “WOOYOUNGMI.COM” and users.
